Client has tendered to Rent San Diego Properties, known as Company, the sum of
If within five days after payment of a fee, the licensee (Company) has not supplied the prospective tenant (Client) with at least three available rental properties meeting the specifications of the contract as to (I) type of structure, (ii) designated area, (iii) furnished or unfurnished (iv) number of bedrooms (v) maximum rental and (vi) any other specification expressly set forth in the contract, the full amount of the fee shall be refunded to the prospective tenant upon presentation of evidence of such failure within ten days after the expiration of the five day period. The prospective tenant is not entitled to a refund if the prospective tenant obtains a rental through the services of the licensee. You may bring a small claims court action against the licensee for his/her refusal to make a refund on your demand of all or part of the fee paid by you under this contract. If the court finds that the licensee has acted in bad faith in refusing to make the refund, the court has the authority to award you up to one thousand dollars ($1000.00) in addition to damages actually sustained by you.” Client initials: The purchase of any other goods or services other than the provision of listing residential real property for tenancy is optional. A person who purchases rental information for purposes other than that of locating a rental unit for personal use or the use of a designated person shall not be entitled to the return of any part of the fee paid to the licensee. The listing information being provided to Client pursuant to this contract is considered proprietary and confidential by Rent San Diego Properties. Client agrees that Client will use it for the sole purpose of locating a rental unit for personal use and will otherwise keep it confidential and not disclose it to third parties without Rent San Diego Properties prior written authorization. Rent San Diego Properties may pursue available legal remedies for the unauthorized use or disclosure of listing information provided under this contract. Client and Company do agree that the previously stated sum tendered to and accepted by Company entitles Client to receive information from Company for a period of 90 days, beginning with the date of payment. Company promises Client to be open for business a reasonable number of hours each week and does further promise to make available to Client all selected listings processed at that time or as frequently as desired by Client during tenure of this agreement by means of fax, e-mail, walk-in or internet download.
